Domestic workers can now claim compensation for injury, death or disease suffered while on duty since 1994.
The Constitutional Court upheld a High Court ruling, declaring a section of the Compensation for Occupational Injuries and Diseases Act unconstitutional.
Domestic workers challenged the legislation, saying it infringes on their rights. The court says their exclusion has a stigmatising effect.
It also says domestic workers remain severely exploited, undermined and devalued. The court ordered the Labour Department to pay the costs of the case.
