Accused number two in the Nathaniel Julies murder case, returns to the South Gauteng High Court on Thursday morning.
Police officer Simon Scorpion Ndyalvane will re-apply for bail based on new evidence.
He and two other officers were arrested after 16-year old Julies was gunned down metres from his home.
The teen with down syndrome had walked to a nearby spaza shop to buy biscuits.
His death sparked massive protests in Eldorado Park.
The accused face charges of premeditated murder, defeating the ends of justice, and firing a gun in public.
